This agreement is between “TCR The Club of Riverdale” and the signed member below. This membership application when signed constitutes the entire agreement.

1. I agree to be bound by the rules, regulations and policies of TCR. A copy may be obtained from the front desk.

2. ANNUAL MEMBERSHIP CANCELLATION I agree that all annual memberships are non-transferable, and membership may be terminated only if the member moves more than 25 miles from the club. Members paying monthly dues will owe any payments due in the 30 days falling after cancellation request approval. Paid-in-full memberships will be refunded pro-rata 30 days from the receipt of a utility bill, lease or mortgage agreement from the new residence. ADDITIONAL RIGHT OF CANCELLATION: If upon a medical doctor’s order you cannot physically receive services of this facility because of significant physical disability in excess of six months. If you become deceased, your estate shall be relieved of any further obligation for payment under the contract not then due or owing. All monies paid pursuant to contract cancelled for the reasons contained in this subdivision shall be refunded within fifteen business days of respect of such notice of cancellation; provided however that the seller may retain the expense incurred and the portion of the price representing the services which the buyer has consumed or wishes to retain after cancellation of contract. MONTH-TO-MONTH MEMBERSHIP CANCELLATION Members paying monthly dues will owe any monthly payments due in the 30 days after providing written request for cancellation. ADDITIONAL CONSUMER RIGHT TO CANCELLATION. You may cancel this contract without further obligation within 3 days from this date. Notice of cancellation shall be given in writing subscribed by the buyer and mailed by registered or certified United States mail to the seller at the address specified in such form. Such notice shall be accompanied by any membership cards, locker keys and any other documents or evidence of membership previously delivered to the buyer. By execution below, member acknowledges that The Club of Riverdale will not reduce, refund any portion, or suspend the membership fee during the time when the facilities, in whole or in part, are not available for use (Holidays/Maintenance/Emergency), or upon the disability of the undersigned, or the absence from the use of the facility by the undersigned. A member’s cancellation of the membership shall not relieve that member of his obligation to make payment of membership fees for the remainder of the year, which will continue to be billed as provided on the other side of this application.

3. PHYSICAL EXAMINATION. All members are encouraged by TCR to have a physical examination to determine present health before strenuous exercise is recommended. It is understood within this agreement that the undersigned represents himself/herself to be in good health and fully capable to participate in any chosen TCR activity.

4. LIABILITY WAIVER. I accept full responsibility for my use of any and all apparatus, appliance, facility, privilege or service whatsoever owned or operated by TCR or while participating in any contest, game, function, exercise, competition or other activity operated, organized or sponsored by TCR. This waiver covers activities inside or outside the building. I agree that I participate at my own risk. I shall hold TCR, its shareholders, directors, officers, employees, representatives, owners and agents, harmless of any loss claim, injury, illness, damage or liability sustained or incurred by myself as a result of my own act or omission of an officer, employee, representative, owner or agent of TCR or its affiliated companies. This hold harmless agreement cover any such loss, cost, claim, injury damage, or liability sustained or incurred by the use of TCR.

5. DUES & FEES. No dues memberships will be accepted nor house charge privileges extended without an active credit card or check account information on file. Checking accounts will be billed the balance accrued on the 2nd of each month. For age / address restrictive memberships; proof is required. I agree to the pay fees associated with loss of a TCR Locker Key ($25) or loss of my TCR ID/Keytag ($5), and delinquency fee for membership payments 15 days past due ($35). I agree that I will take a photo for my TCR profile, and I consent to TCR using my image if taken during a photo shoot of facilities.

6. AUTO RENEWAL Annual memberships will convert to a month-to-month membership after the 12th month and retain their current monthly rate until the membership type is no longer valid. Written notice of cancellation request must be provided at least 30 days prior to annual expiration to avoid auto-renewal.

I have read and fully understand the above agreement, the rules, regulations and policies of ‘TCR The Club of Riverdale’. Additionally, all my questions have been answered to my satisfaction.
